rest of the cabinet members as well as legislative action we believe is required. lou: at the state level, new york governor andrew cuomo proposing what he calls the toughest assault weapon ban the nation. thdemocratic governor suggesting that the state government has the power to seize guns. infuriating gun owners and gun rights advocates when he suggested that confiscation could be an option. the assault on the constitution certainly not limited to the second amendment. congressional democrats are now urging the white house to act unilaterally on the debt ceiling as well. twenty-one democrats led by congressman peter welch said in a letter that they fully support any use of presidential authority, including interpreting the 14th amendment to support presidential action to prevent the government from going into default. that amendment contained a section stating that the validity of the public and the united states shall not be

questioned. at best interpret those words to be authorization for the president to act on his own is to say the least eight tortured reasoning. and as a matter of law, the federal borrowing limit is set by congressional approval. the white house, not as adventurous as the democrats in congress to send that letter. the white house unwilling to take on more than one constitutional amendment and challenge at a time. white house spokesman jay carney today. >> the proposition on the 14th amendment has not changed. let's be clear. congress has the responsibility and the sole authority to raise the debt ceiling. congress must do its job. lou: the administration does appear willing to go around congress to enact at least some gun-control measures. we will be debating tonight the administration's efforts to broaden and control in this country, talking with former birdie campaign president richard a. bourne in

of the independent institute and an adjunct professor of advanced constitutional law at denver university stern college of law. good to have you with us. richard a. bourne, criminal justice expert and fellow president of the brega campaign. good to have you with us. >> huckabee year. lou: let me ask, if i may begin with you, david. you just heard me ask carl cameron about this issue. is the idea of using executive order appropriate in the instance of banning a particular type of weapon? >> well, certainly it comes to the possibility. to be technical, what the president would be most likely to do would not be an outright ban but would be to say that certain guns he deems to be destructive devices under federal law, and so therefore there will be treated like the same with machine guns are. to continue to possess one, you have to pay $200 to the federal government per gun, get

fingerprinted, and also photographed and also get authorization form. lou: you think it is feasible. >> at think there would be quite a court fight over it, but it is possible he could get away with it. presidents have gotten away with a lot of very aggressive interpretations of their powers and often those are upheld by the courts, even when the law might be stronger on the other side. lou: in this debate for a long time. to you think that what you heard david say, does that give you hope that the president might do this? >> at think it is a reach to far. and it is an interesting constitutional question, the president has not even come close to talking about impacting assault weapons. they're talking about very different things that fall within a law enforcement round. lots of things that the president could do using the justice department. establish a central office of prosecution for gun cases, an interstate strike force like we used to break up the mafia,

investigate problem some gun shows where we know guns are looking into the illegal markets. there are numerous examples of where we could increase law enforcement capability, all of which could be done by executive order, and none of which comes even close. lou: this city thathas one of, if not the strongest gun laws, chicago, is right now the murder capital of the country. what is the relationship between gun laws and crime, the relationship between guns broadly in the society in the crime rate. >> we could argue over that for hours. there are studies that go in both directions. more dangerous to live in chicago then it is to be a

soldier in afghanistan. the seventh circuit court of appeals decision handed down a few weeks ago said that illinois cannot be his allies state that refuses to recognize the second amendment right to bear arms. and it is okay to have a licensing process to make people go through a background check, safety training, but illinois cannot continue under the system where people are forbidden to carry guns in public for protection unless you are in some special category like a security guard or alderman. alderman can carry guns anywhere they want, but ordinary citizens cannot. >> politics is a dangerous business it. lou: particularly in cook county in the state of illinois. you remember an investigation for criminal charges. quite a different place when it comes to ethics and public service. but to the point, we are right

now watching an administration sellout on the area that they're going to do something about control. is starting to sound like the republicans are saying, do what you will. we will talk about matters that we consider much more important, and were going to have this debate when we choose, not the way you play in your game of urgency and emergency decision as in the case of obamacare for the fiscal cliff fiasco. what do you think? is it time for change? >> to be blunt, the urgency is the number of people dying. do you realize, there are more americans killed by guns in this country every single year than there are more american soldiers killed in all of the years of afghanistan and iraq combined. we have a crisis on our hands, and every day we let go by without intervention more people died. so there is an urgency of the upmost importance, and i do think the obama administration

and the congress needs to act. interestingly, if you listen to this debate, take up the partisan interest, you're beginning to see the emergence of my good, comprehensive discussion which is, gun owners who deplore the violence occurring with guns are beginning to say, can we strike a balance between our right to get a gun and in contol. the answer is unequivocally we can. lou: you get the last word. one of the things that disturbs me, there is room for a reason. in his room for a bounce in interest. there is a broad, this attitude that there will be doing, gun owners and those who wish to own guns a favor by not stripping their hands of those guns. >> president obama in his career as an illinois legislature signed various questionnaires, and is votes in the illinois legislature voted to support
